ACKNOWLEDGEMENT AND ACCEPTANCE OF RISKS form
WHEREAS SegwayTours.ro allows me to use the environment of one or many parks in Bucharest and some equipment, which may include electric scooters, accessories and borrowed material surrounding the practice of the chosen activity, it is agreed that:
1) INHERENT RISKS IN THE ACTIVITY
The risk of the activity in which I participate are more particularly, but not limited to:
- Injuries from falls or other movements (sprain, strain, fracture, etc.)
- Injuries due to contact with the natural environment (sprain, strain, fracture, etc.)
- Injuries with blunt or sharp objects (branches, equipment, etc.)
- Injuries resulting from a contact, accidental or not, between individuals
- Burns or disorders due to heat
- Death
2) RULES AND ASSUMPTION OF RISKS
I am aware that the activities offered by SegwayTours.ro occur in natural or semi-natural environments possibly injured. I know it is strongly recommended to wear the helmet and the protections offered by SegwayTours.ro. I promise to listen carefully to the tips, advice, prohibitions and safety rules explained during training and throughout the activity. I am also committed to play an active role in the management of these risks by adopting a preventive attitude towards me as well as in regard to other people around me. I acknowledge that the guide has the right to exclude any person he deems a risk for her or him, for the rest of the group or for the loaned equipment or even stop the activity before the end without refund in case of inappropriate behavior or inability to control the scooter properly. I understand that it is impossible for me to go away from the group and the person in charge for any reason. If I want to leave the tour, I will await the approval of the guide and expect no refund. Therefore, I accept freely me bend the rules of safety and I fully assume all risks arising out of the activities offered by SegwayTours.ro.
3) CANCELLATION POLICY
As long as there is no bad weather (rain, snow or any natural cause that makes it impossible to ride the electric scooters) at the beginning of the tour, everything will start as planned. If a rainfall/snowfall/intense wind starts during the tour, we will find a covered place and wait that it calms down. If the rainfall/snowfall intense wind doesn’t stop after 30 minutes of waiting, we will try to reschedule a small tour along the guide availability and mine. If no arrangement is possible, the activity is going to be cancelled without refund.
If you ask for a cancellation, you can ask for a full refund if that’s more than 7 days in advance or a 50% refund if you’re more than 48 hours in advance. For last minute changes, no refund is possible.
4) RESPONSIBILITY DISCHARGES ON THE PERSON AND ON HIS OWN MATERIAL
You fully emerges SegwayTours.ro from any liability, claims, lawsuits or actions arising out of damage that I may suffer or that I could bring to others by participating in activities covered by this agreement. I also waive any claim and any lawsuit for damages on equipment belonging to me (normal wear, loss, breakage, theft, vandalism).
5) TAKEN RESPONSIBILITY ON THE MATERIAL BORROWED
I understand that with the explanations “how to use” the electric scooters and any equipment loaned by SegwayTours.ro, with the suggested precautions and territory restrictions imposed by the person in charge, I should have all the tools for using properly the equipment and prevent damage. If unfortunately the equipment that I will use come back damaged or in a different shape than how it has been loaned to me, I agree to pay monetarily, on the spot or in the same day, the damage. Additional penalties may be added in case of payment delays.
6) indemnity obligation
I agree to indemnify and hold harmless SegwayTours.ro for any loss, claim, action or any legal action that may be incurred. Compensation includes reimbursement of all legal costs and reasonable attorneys’ fees incurred by SegwayTours.ro, by the participant and by the indemnified parties, compensated for the defense of any action arising directly or indirectly from the activities of the participant under this agreement.
7) AUTHORIZATION TO INTERVENE IN AN EMERGENCY
I authorize SegwayTours.ro to provide all the necessary first aid. If there is information related to my health, a medication or something that could cause a hazard in the event of medical intervention, I agree to notify the person in charge at the beginning of the activity. I also authorize SegwayTours.ro to make the decision in the case of an accident to transport me (by ambulance, helicopter or otherwise) in a hospital or health center, to my own expense.
8) PHOTOGRAPH AUTHORIZATION
I agree to be photographed and recorded in video during my participation in the activities and with the publication of these photographs and / or video for advertising, promotion and marketing purposes.
9) MAINTENANCE OF OBLIGATIONS
I acknowledge and agree that the conditions of the above clauses (number 1) to 8)) are consistent with the Romanian laws, remain in effect at all times and be binding upon the heirs, executors, administrators or assigns. I understand that SegwayTours.ro allows me to participate to the activity only if I sign and fill completely this act. The agreement is valid not only for the chosen tour, but for any activity surrounding (including the introduction, training, transitions, conclusion, etc.).
I HAVE READ THIS AGREEMENT CAREFULLY, I FULLY UNDERSTAND THE CONTENTS OF THE ABOVE 9 CLAUSES. I CERTIFY THAT I HAVE 18 YEARS OLD OR MORE OR THAT I HAVE 12 YEARS OLD OR MORE WITH THE CONSENT OF A PARENT OR A GUARDIAN.
PARENT CONSENT( if the case): I AM THE PARENT OR THE GUARDIAN OF THE MINOR WHO HAS SIGNED THIS AGREEMENT. I READ BOTH PAGES AND I UNDERSTAND THAT IT CARRIES A FULL AND FINAL RELEASE FOR SegwayTours.ro WITH RESPECT TO ANY CLAIM FOR LOSS OR DAMAGE THAT MAY BE SUFFERED BY THE MINOR. I CONSENT TO THE MINOR’S PARTICIPATION AND AGREE TO THE TERMS OF THE AGREEMENT ON BEHALF OF THE MINOR. I AGREE TO INDEMNIFY PROVIDER, ITS AGENTS AND EMPLOYEES FROM ANY CLAIM THAT MAY BE MADE AGAINST THEM BY OR ON BEHALF OF THE MINOR.
